I was laid off from company A in MAY 2002 (got salary till 31st May), later joined company B from 1st July 2002, so, I think, I was �out of status� for 1 month, later left company B because of differences on 31st October 2002 (received salary till 31st Oct ) and filed for H1 transfer with other company C on 11th November 2002, I got H1 approval on March 10th 2003, and started working with company C from April 2003 till now, so have 5 months gap between company B and C.
Was I out of status? If yes, looks like I was out out status for 6 months (5months continues plus 1 month earlier), unfortunately this comes to 181 days (june, nov,dec,jan,feb,march).
My I-94 was never expired and I went to India in Feb 2007 and got H1B stamping done and entered US with no problem.
I started my labor with current employer in May 2004 and got I40 approved as well, now filed for 485 in july rush, got EAD and fingerprinting notice, I am worried that my 485 may be denied because of �out of status� in past.
My Question:
1.Was I technically out of status and unlawfully present?
2.How does 180 days calculated? (continues 180 days or 180 days added in two time span like mine)?
3.If there was any out of status or unlawful present in past, Is it erased after lawful entry in US (I did enter in US this year after H1 stamping in India)?
4.Is Fingerprinting notice assures that everything is fine except security and criminal check?

I am currently on H-1B and filed for Adjustment of Status. I filed my I-485, AP, & EAD in August 2007. I got my EAD and AP in 2007 and it expired last year as well. I did not use the AP. I am with the same employer that filed my green card application. I am continuing on H-1B and did not use EAD.
My H-1B is valid till April 2010. I have not applied for the extension of my EAD & AP. The H-1B stamp on my passport expired in August, 2007. Also, my passport is valid till October 2009. My wife is on H-4 and the visa stamp on her passport also expired in August 2007. Her H-4 is also valid till April 2010. I am planning a trip to India in the coming month.

I am in 5th year of my H1B visa and have visa stamped through the end of September 2010. I am traveling to India May 15th, 2010 and returning to the US on June 6th, 2010. That means I will have about 4 months of valid visa by the time I will be entering the USA. I am planning on renewing my visa after returning to the US. On a side note, my labor has ben approved and filed I-140 recently.
My questions is, do you think I have to start my H1B visa renewal before I leave to India or I can apply for renewal after I return?
Any suggestions appreciated!

There is always an ad for rain gear in the back of photo mags by this one company...I can't think of their name at the moment but I'll find it when I get home. Stuff looks pretty neat.
I've seen those ads, but wonder how effective the products are. I bought one after seeing it in an add and it fits perfect with my 300 but with smaller lenses it's to big. I was hoping I might hear from someone who has one for a smaller lense (17-80 ish).

The Department of State has published a pamphlet educating nonimmigrant visa holders on their rights. The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. Is Employer required, by law, for H-1B fling for qualified job applicant? My understanding is that it is upto the employer whether to file any visa sponsorship (including H-1B) for applicant. And its' employer's choice to put "No visa sponsorship" in the job advertisement.

My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.
Not according to this:
8 1255. Adjustment of status of nonimmigrant to that of person admitted for permanent residence.
(a) Status as person admitted for permanent residence on application and eligibility for immigrant visa

You will be using XNA Game Studio (installs into Visual Studio), to develop games. All your time other than for graphics will be spent in Visual Studio 2010. Highly recommend you have a device. Testing in the emulator is not the greatest for games.
Note: All you need is the freely available tools (Express Editions). Having the student or paid versions does not really benefit those using the XNA Game Studio, or building applications for WP7. I'm sure that page says that, just didn't want you to get confused.
If you have done any other game programming you will find everything pretty easy, just takes a bit to get use to. It sounds like you are new to C#, but don't worry most tutorials are setup in a way this shouldn't be a problem.
The MSDN Create site has code samples and there are lengthy tutorials online that will help you get started with XNA.

Call them and have it rectified immediately...if you delay changing that category would be difficult....what did u have on old EAD card? Don't delay at all. Send all proofs about your gender. Don't panic!!!...i had same problem for my DL...later i got it corrected within 2 days...i had no problems...
I am a July 07 filer. Recently I sent in EAD renewal application and got it approved within a month. When I saw my EAD card the Sex category on it was F instead of M. Now what are my option. Should I reapply for EAD or continue working on it. I changed my employer last month and am currently working on EAD.

I applied for my first labor in 2004 Feb, due to backlog center processing and I140 RFE so I applied for second labor from same employer in 2006 Sept.
Second labor and I140 cleared with out any problem, mean while during in 2007 July I applied I485 based on my second labor.
Later after six months my first I140 was cleared.
My question to IV Guru's, Is there any process to interfile older priority date to the second
labor. I mean is there any process to restore priority date of first labor to second one. As my I485 application is based on second labor.
Any suggestions are appreciated.
