OK...I just got an email from my Attorney. It is indeed what she thought. She received our receipts today from the CSC. The receipts have a receipt date of July 23rd and a notice date of September 19th. As to why the CSC sent out the other notice transferring the case back to NSC to me only and not the Attorney...that is a mystery. She plans to speak to our State Senator and hopefully get some answers.

No point in dreaming about getting any support from dems, they will bring up DREAM act for illegals and will hold legals hostage until CIR.
Our best chance is to get support from the republican pro-legal immigration senators like - Cornyn, Kyl, Judd Greg etc..

I was wondering if an attorney or any user with knowledge / past experience with I-485 MTR can help me understand the status of my MTR.
My story in short:
* EB2 I-485 was applied in July 07
* I -140 was approved in Aug 07 timeframe
* No change in employer, etc. Life as usual.
All of a sudden:
* Received I-485 denial on July 30, '09. No RFE no NOID. PD = Nov 06. Reason stated: underlying I-140 was not valid.
* Obvious USCIS error. I-140 is alive n kicking. So applied for MTR on Aug 14.
* Convinced my attorney to request for expedite based on USCIS error. Got a letter from TSC that the expedite was accepted on Sept 11. Attorney said I should hear in a weeks time, but the letter said within 45 days!
* On Sept 25 there was an LUD on my I-485. Status of MTR still = initial review.
* Got impatient today and called USCIS. Managed to get to level II. The courteous rep told me that on Sep 24 my I-485 was reopened for reconsideration. Online it still says 'denied'.
She also mentioned that the MTR has not been approved yet. Also that she could see a lot of activity going on with my case and someone has been assigned to it, which according to her was a good thing. God only knows what is 'good' per USCIS.
I know it will take ages for the GC, but at least the AP was coming to good use. Now I'm stuck w/o a stamped visa and unable to make business trips either. Can someone share their thoughts on what happens next, if all turns out good with my application.

Hi guys,
We have been trying to talk to somebody consequential at the US Embassy in New Delhi because of a medical emergency. My wife and son both are in India. My son, who is a US citizen requires immediate medical assistance in US. Unfortunately, my wife does not have any visa at this moment because of some technicalities.
We are trying to contact somebody from the embassy staff who can assist us in getting an emergency visa appointment. we tried to call the numbers given on their website, but we are only able to reach low level operators who simply redirect us to another automatic voice mail number. Also, writing to their email address is not proving anymore helpful. Mostly we don't even get any reply to our emails. Sometimes we simply get some automatic response to our emails which is not at all relevant to our requests.
So if anybody has any direct number/email of some senior embassy staff, please forward it to us. It will be really helpful for us.

Technically ...... "ZERO" (no time-gap).
But don't worry about it too much (what can you do). Get your next job ASAP, and file for "premium processing".
In the past "extension of status" petitions had got approved even after almost a month gap, with good explanation. But you can never count on that.
Worst thing that can happen for a valid new H1 job is USCIS approve your H1 but reject your "extension of status" (I797 without I-94 attached). In that case, you might need to travel outside of USA and get your visa.
Either way, don't go beyond 180 days. There will be additional consequences.

Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways :confused:

Actually I wanted to know if one doesn't go out of the country and stays back in the US, and remains unemployed for whatever reason for say 6 month or more- medical, personal etc or perhaps just take a break.
As long as you have things to explain when you are up for naturalization. I know some who quit their jobs a few months after getting GC to go back to school.

Is this for H4 renewal or first time H4. If its for renewal she can go to any US consulate in India. However, if it is first time she has to go the consulate that falls in her zone i.e her place of residence. Confirm it with VFS.
